  1. Introduction

These Terms and Conditions govern your use of our classes and any associated services. By participating in our classes, you agree to comply with these Terms. Mighty Mums reserves the right to update or modify these Terms at any time without prior notice.

  1. Acceptance of Terms

By registering for or attending any class, you confirm that you have read, understood, and agree to these Terms and Conditions. If you do not agree with any part of these Terms, please refrain from using our services.

  1. Eligibility

Our services are designed for women, primarily new mums and postnatal clients. Participation is only permitted for individuals over the age of 18. All participants must ensure they are physically and medically fit to engage in our classes. If you have any health concerns, you must seek medical clearance from a healthcare provider before attending.

  1. Health Disclaimer & Liability Waiver

You acknowledge that participation in any physical activity carries a risk of injury. To the extent permitted by law, Mighty Mums and its instructors will not be liable for any injury, damage, or loss arising from participation in classes. You are responsible for your own safety and well-being during our sessions.

  1. Participant Responsibilities

You confirm that you are medically fit to participate in exercise and, where required, have received clearance from your healthcare provider. We also strongly recommend consulting a pelvic health physiotherapist before beginning any exercise program. Participants are responsible for informing the instructor of any injuries, health conditions, or changes in physical status that may affect their ability to participate safely in class.

  1. Babies and Children

Mighty Mums classes are designed to be attended by mothers with their babies. However, parents and caregivers remain fully responsible for the supervision, safety, and care of their child at all times during classes.

  1. Class Booking and Cancellation Policy

Classes must be booked in advance via our online booking system. Cancellations must be made at least 8 hours prior to the class start time to avoid a late cancellation fee. Cancellations made within 8 hours of the class will be charged at the full class rate. No-shows will also be charged at the full class rate.

  1. Payments and Refunds

Payments for classes, memberships or packages must be made in advance via our booking platform. We do not provide refunds for missed classes or change of mind. However, nothing in these Terms excludes or limits your rights under Australian Consumer Law. If a class is cancelled by Mighty Mums, participants will be offered either a credit or a refund.

  1. Changes to Classes or Services

Mighty Mums reserves the right to modify or cancel classes, change instructors, or alter venues as necessary. We will notify participants of any changes as soon as possible via email, SMS or the Mighty Mums WhatsApp group.

In the event of unsafe weather conditions (such as heavy rain, extreme heat, or storms), classes may be cancelled or rescheduled. Participants will be notified as soon as possible and will be offered either a make-up session or an online class in its' place.

  1. Code of Conduct

We strive to create a supportive and welcoming environment. All participants are expected to behave respectfully towards instructors and fellow members. Disruptive, inappropriate, or unsafe behaviour will not be tolerated and may result in the termination of your participation without a refund.

  1. Photography and Media Consent

We may take photographs or short videos during classes for promotional purposes including social media and website content. By participating in classes, you consent to the use of your image unless you notify the instructor in advance that you prefer not to be included.

  1. Privacy and Data Protection

Mighty Mums values your privacy. We collect and use your personal information to provide our services and communicate with you. Your data will be handled in accordance with our Privacy Policy, which can be accessed here (insert link to privacy policy). Health information provided in pre-exercise questionnaires may be shared with relevant health professionals (such as physiotherapists) with your consent in order to support safe participation in classes.

  1. Intellectual Property

All materials provided during classes, including workout routines, are the intellectual property of Mighty Mums and are intended for your personal use only. You agree not to copy, distribute, or use any content for commercial purposes without prior written permission.

  1. Termination of Services

Mighty Mums reserves the right to terminate your participation if you breach these Terms and Conditions or engage in misconduct. In such cases, you will not be entitled to a refund.

  1. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes will be resolved under the jurisdiction of the New South Wales courts.
